General Conditions Of Use
ARTICLE 1 : OBJECT
These General Conditions of Use legally govern the use of the services of the LumiMakr site (hereinafter referred to as “the site”).
Constituting the contract between the company LumiMakr and the User, access to the site must be preceded by acceptance of these T&Cs. Access to this platform signifies acceptance of these T&Cs.
ARTICLE 2 : LEGAL NOTICE
The LumiMakr site is published by the company LumiMakr registered with the RCS under number 791 737 174, whose head office is located at Domaine de Tiara, Résidence Ilona bat a, 423 avenue des Frères Buhler, 34080 Montpellier.
The site host lumimakr.com is the iTomation company based in Toronto, Canada.
ARTICLE 3 : ACCESS TO THE SITE
The LumiMakr site provides free access to the following services:
- Sale of software solutions and plugins (LumiMakr Video, LumiMakr Photo),
- Download trial version(s)(LumiMakr Video, LumiMakr Photo).
The site is accessible free of charge from anywhere by any user with Internet access. All costs necessary for access to the services (computer equipment, Internet connection, etc.) are the responsibility of the user.
Access to services dedicated to members is carried out using a username and password.
For maintenance or other reasons, access to the site may be interrupted or suspended by the publisher without notice or justification.
ARTICLE 4 : COLLECTION OF DATA
For the creation of the User’s account, the collection of information at the time of registration on the site is necessary and obligatory. The member retains all of his intellectual property rights. This can be done directly or through an authorized third party. This concerns in particular the right to use the publication on the web and on mobile telephone networks.
Each time it is used, the publisher undertakes to mention the name of the member near the publication.
The user is held responsible for any content he puts online. The user undertakes not to publish content likely to harm the interests of third parties. Any legal proceedings initiated by an injured third party against the site must be borne by the user.
The Site may delete or modify User Content at any time, for any reason, without notice.
ARTICLE 10 : CONTRACT LENGTH
This contract is valid for an indefinite period. The start of use of the site’s services marks the application of the contract with regard to the user.
ARTICLE 11 : APPLICABLE LAW AND COMPETENT JURISDICTION
This contract is subject to French legislation. The absence of an amicable resolution of disputes between the parties implies recourse to the competent French courts to resolve the dispute.
